Terms of Service

Effective date: 17 May 2026

These Terms of Service (“Terms”) govern your access to and use of the appply recruiting platform (“Service”) provided by Foreach Labs, a company registered in France with its registered office at 51 Boulevard de Strasbourg, 59000 Lille, France, operating the platform under the trade name “appply” / “appply.ai” (collectively “appply”, “we”, “us”). By signing up for or using the Service you (“Customer”) agree to be bound by these Terms. This document is written in English; it is the binding version.

1. The Service

appply is a software-as-a-service recruiting platform that:

  • Generates job advertisements from briefs you send via WhatsApp;
  • Publishes those advertisements to third-party job boards we select for your country and budget;
  • Operates a dedicated WhatsApp number for receiving applications;
  • Uses artificial intelligence to converse with applicants on your behalf, ask screening questions, and propose interview slots;
  • Introduces qualified candidates to you via WhatsApp once our AI assesses them as a fit.

The Service is delivered using the WhatsApp Business Platform operated by Meta Platforms, Inc. (“Meta”) and through third-party job boards. You acknowledge that your use of the Service is also subject to Meta’s terms (see §6) and to the terms of each job board on which we publish on your behalf.

2. Eligibility and account

You must be at least 18 years old and act in a business capacity to use the Service. You must register an account with accurate, current information and keep it up to date. You are responsible for all activity on your account and for keeping your credentials secure. You must promptly notify us at [email protected] of any unauthorised use.

3. Acceptable use

You agree that you and anyone using your account will not:

  • Post job advertisements that are illegal, fraudulent, discriminatory, or that violate applicable employment law (including non-discrimination on the basis of gender, race, religion, disability, age, sexual orientation, gender identity, or any other protected characteristic);
  • Use the Service to send spam, marketing messages unrelated to recruitment, or messages that violate the WhatsApp Business Messaging Policy;
  • Misrepresent yourself, your business, or the role being recruited;
  • Collect or extract data about applicants beyond what is necessary to evaluate them for the advertised role;
  • Re-identify, sell, share, or otherwise misuse applicant data outside the recruiting context for which it was collected;
  • Reverse engineer, decompile, or attempt to extract our source code or AI model weights;
  • Interfere with, disrupt, or place an unreasonable load on the Service;
  • Use the Service to violate any applicable law, including data-protection, labour, or consumer-protection law in your jurisdiction.

We may suspend or terminate accounts for violations of this section, with or without notice, and we are required to do so in some cases by Meta or by the job boards we publish on.

4. Your data, applicant data, and our role

  • Recruiter data: You own and remain responsible for the information you provide to the Service. You grant us a non-exclusive licence to use it as needed to provide the Service.
  • Applicant data: You are the data controller for personal data of applicants we process on your behalf; we act as your data processor. Our data-processing terms (DPA) are incorporated into these Terms by reference and are available on request to [email protected].
  • You warrant that you have a lawful basis to collect applicant data and that you will respond to applicant data-subject requests forwarded by us within statutory deadlines.

5. Pricing and payment

Pricing is presented on our pricing page or in your order form. Unless stated otherwise:

  • Subscription fees are billed in advance, monthly or annually;
  • Fees are non-refundable except as required by law;
  • Pay-per-hire or success-based fees are billed within 30 days of the qualifying event;
  • Taxes (including French VAT where applicable) are added to invoiced amounts.

Late payments accrue interest at the rate set by Article L441-10 of the French Commercial Code, plus a fixed €40 recovery indemnity per invoice (Article D441-5).

6. WhatsApp / Meta compliance

You acknowledge and agree that:

  • The Service relies on the WhatsApp Business Platform, and your use is subject to Meta’s WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, and the WhatsApp Commerce Policy.
  • Messages you cause us to send may not include prohibited content under Meta’s policies (e.g., regulated goods, scams, weapons, adult content).
  • Meta may impose template-message requirements, rate limits, and policy reviews; we will pass these through to you and you agree to comply.
  • We may immediately suspend the Service to you if Meta requires it, if your usage causes us to risk a policy violation, or if we reasonably believe a violation has occurred.

7. Job-board compliance

We publish to third-party job boards. Each board has its own terms, content policies, and dispute mechanisms. By submitting a brief, you authorise us to publish job advertisements on your behalf on the boards we select, and you agree to comply with the terms of each such board. We are not liable for moderation decisions made by third-party job boards.

8. Intellectual property

We own all rights in the Service, including software, AI models, content, designs, and trademarks (“appply”, the logo, and the wordmark). You receive a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service during your subscription, solely for your own internal business purposes.

You may give us feedback about the Service. We may use such feedback freely without obligation.

9. Confidentiality

Each party will protect the other’s non-public information with the same care it uses for its own confidential information (and no less than reasonable care), use it only for the purposes of these Terms, and not disclose it except to staff or contractors bound by similar confidentiality obligations.

10. Disclaimers

The Service is provided “as is” and “as available” to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any specific candidate will be hired or remain employed. AI assessments are probabilistic and intended as a screening aid, not as a hiring decision; the hiring decision is always yours.

To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • Neither party will be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, or data.
  • Each party’s total cumulative liability arising out of or relating to these Terms and the Service will not exceed the total fees you paid us in the 12 months preceding the event giving rise to the claim, or €100, whichever is greater.

These limitations do not apply to: (a) breaches of confidentiality; (b) infringement of the other party’s intellectual property; (c) indemnification obligations; or (d) liability that cannot be excluded under applicable law (including gross negligence and wilful misconduct under French law).

12. Indemnification

You will indemnify, defend, and hold us harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising out of your job briefs, your communications with applicants, your violation of applicable law (including employment, data-protection, and Meta’s policies), or your breach of these Terms.

13. Termination

You may terminate your subscription at the end of any billing period via the in-product cancellation flow or by emailing [email protected]. We may terminate or suspend your access for material breach (including breach of §3 or §6) with notice, or immediately where Meta or a job board requires it.

On termination:

  • You stop being charged for future periods;
  • We return or delete your data as described in our Privacy Policy;
  • Provisions that by their nature should survive (intellectual property, confidentiality, disclaimers, liability, indemnity, governing law) will survive.

14. Modifications

We may update these Terms from time to time. Material changes will be notified by email to your account contact and via a banner on the Site at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by French law, without regard to its conflict-of-laws rules.

Before initiating any dispute, the parties agree to attempt good-faith resolution by negotiation for at least 30 days. If unresolved, exclusive jurisdiction is granted to the competent courts of Paris, France, subject to mandatory consumer-protection rules where they apply.

16. Miscellaneous

  • Entire agreement: these Terms (together with any order form, our Privacy Policy, and any Data Processing Addendum) constitute the entire agreement between us.
  • Assignment: you may not assign without our prior written consent; we may assign in connection with a merger, acquisition, or sale of assets.
  • No waiver: failure to enforce any provision is not a waiver.
  • Severability: if any provision is held unenforceable, the remaining provisions remain in effect.
  • Notices: to us, [email protected]; to you, the email on your account.
  • Force majeure: neither party is liable for delay or failure due to events beyond reasonable control.
